Why Do Muslims Need an LPA?

A Lasting Power of Attorney (LPA) allows you to appoint trusted people to make decisions on your behalf if you lose mental capacity. As Muslims, it is vital to ensure that whoever manages our affairs does so in accordance with Islamic principles.

Without an LPA, decisions about your finances, health, and welfare could be made by someone unfamiliar with Islamic requirements - potentially resulting in riba-based investments, non-halal food in care settings, or medical decisions that conflict with Shariah.

Islamic Guidance on Choosing Attorneys

It is strongly recommended to appoint practising Muslim attorneys who understand Islamic principles regarding finances, investments, and welfare. They should be trustworthy (Ameen), competent, and willing to act in accordance with Shariah.

How Should Your Attorneys Act?

Jointly

All attorneys must agree on every decision. If one can no longer act, none of them can act (unless you have replacement attorneys).

Jointly and Severally

Attorneys can make decisions together or independently. If one can no longer act, the others can continue.

Mixed

Jointly for some decisions, jointly and severally for others. You must specify which decisions require joint agreement.

When Can Your Attorneys Act? (Property & Financial)

Choose when your attorneys can start making financial decisions on your behalf.

As Soon as the LPA is Registered

Your attorneys can act immediately after registration, even while you have full mental capacity. This can be useful for day-to-day financial management.

Only When I Lack Mental Capacity

Your attorneys can only act if and when you are unable to make your own decisions. A medical assessment may be needed.

Why Appoint Replacement Attorneys?

Replacement attorneys step in if one of your original attorneys can no longer act (due to death, incapacity, or choice). It is recommended to appoint at least one replacement to ensure your Islamic preferences are always upheld.

Who Should Be Notified?

These people will be notified when your LPA is being registered with the Office of the Public Guardian. They can raise concerns if they believe the LPA should not be registered. You can name up to 5 people.

Consider notifying: a family member, your imam, a trusted friend, or a community leader.

Islamic Instructions & Preferences

Section 6 of the official LPA form - this is the most important Islamic section

Instructions vs Preferences

Instructions are BINDING - your attorneys MUST follow them. Preferences are guidance - your attorneys should consider them but have flexibility.

The pre-selected Islamic instructions below will be written into Section 6 of the official government form.

Binding Islamic Instructions (Property & Financial)

Your attorneys MUST follow these instructions. Tick the ones you want included in Section 7 of the official form.

Prohibition of Riba (Interest): My attorney must NOT place my money in any interest-bearing accounts, bonds, or instruments. No interest-based loans, mortgages, credit cards, or overdrafts. Any interest inadvertently received must be donated to charity. Shariah-Compliant Investments: All investments must avoid companies involved in: alcohol, gambling, tobacco, conventional insurance, pork, adult entertainment, conventional banking, and weapons. Investments must be screened by a recognised Shariah advisory board. No speculative trading (Gharar). Zakah Obligations: My attorney MUST calculate and distribute my annual Zakah obligations from my wealth. Zakah must be distributed to the eight categories of eligible recipients as specified in Surah At-Tawbah (9:60). Financial Consultation Requirement: For any significant financial decision, my attorney must first consult with a recognised Mufti or Shariah advisory body to confirm the transaction is permissible. A written record of consultations should be maintained. Property Management: My attorney must NOT rent out any of my properties for Haram purposes (alcohol-licensed premises, gambling, nightclubs). All rental agreements and property transactions must be Shariah-compliant.

Preferences (Guidance for Attorneys)

These are non-binding guidance. Your attorneys should consider them but have flexibility.

Islamic Banking: I would prefer my banking to be conducted through Islamic banks or Shariah-compliant financial institutions (e.g., Gatehouse Bank, Al Rayan Bank). Regular Charity: I would prefer that my attorney maintains a charitable giving practice of Sadaqah on my behalf, including during Ramadan and on Fridays. Debt Settlement Priority: If I have outstanding debts, I would prefer these to be settled as a priority, as the Prophet (peace be upon him) emphasised the importance of settling debts.

What is a Certificate Provider?

A certificate provider is an independent person who certifies that you understand the LPA, that no one is forcing you to make it, and that there is nothing to prevent it from being created.

They must be either:

Someone who has known you personally for at least 2 years, OR
A professional (solicitor, doctor, social worker, etc.)

They cannot be: one of your attorneys, a family member of an attorney, or someone under 18.
